EDEN LAW CHAMBERS – REFUND POLICY

At Eden Law Chambers, we are committed to delivering professional legal services with the highest level of integrity, transparency, and client satisfaction. We understand that certain circumstances may arise where a client may need to cancel an engagement or request a refund. This Refund Policy outlines the terms and conditions under which refunds may be issued for our professional legal services.

1. Scope of the Policy

This policy applies to all clients who engage Eden Law Chambers for legal services, including but not limited to:

  • Company incorporation and registration
  • Immigration services
  • Real estate transactions and conveyancing
  • Trademark and intellectual property matters
  • Licensing and regulatory compliance
  • Contract drafting and advisory
  • Legal opinions and due diligence

2. Payment Structure and Service Stages

Legal service engagements are typically divided into the following stages:

Each service quote or proposal specifies which stages are included, the timeline, and related deliverables.

3. Refund Eligibility

Refunds are subject to the stage of service delivery at the time of the cancellation request:

3.1 Full Refund

A full refund of the professional fee (excluding government or third-party charges) is applicable when:

  • The engagement is cancelled before any legal work has commenced, and
  • No documents or filings have been prepared or submitted.

3.2 Partial Refund

A partial refund of the professional fee may apply as follows:

Work commenced but not submitted

Up to 75% refund

Drafting or document preparation completed

Up to 50% refund

Submission to authorities done

Up to 25% refund (if service not fully completed)

Service fully completed

No refund applicable

Note: For milestone-based projects, completed milestones are not refundable.

3.3 Government and Third-Party Fees

  • Refundable: Only if not yet paid or submitted to the relevant government or third-party institution.
  • Non-refundable: Once paid to the relevant authority (e.g., BRELA, TRA, Immigration Department, TMDA, etc.), government fees are not recoverable.

4. Force Majeure and External Constraints

In case the process cannot be completed due to unforeseen administrative, regulatory, or jurisdictional constraints not caused by the client, Eden Law Chambers will:

  • Provide a detailed report on the steps completed,
  • Attempt to reallocate resources to alternate solutions where possible, and
  • Offer a fair refund, assessed based on the stage of progress

5. Refund Procedure

To initiate a refund, the client must:

  1. Submit a written request to info@edenlawchambers.co.tz stating the reason for cancellation.
  2. Attach the engagement letter or proposal, proof of payment, and any supporting documents.
  3. Allow up to 7 business days for assessment and resolution.

Refunds will be made to the original method of payment unless otherwise agreed in writing.

6. Exclusions

Refunds will not be issued in the following cases:

  • Delay caused by the client (e.g., late provision of documents, non-cooperation).
  • Change of mind after service delivery has commenced.
  • Failure to obtain a desired outcome when the service was delivered professionally and diligently.
  • Dissatisfaction with third-party or government procedures outside Eden Law Chambers’ control.
